Unmanned aerial vehicles, commonly referred to as "drones," are increasingly being used around the world. W
Poland is also seeing an increase in interest in these devices, especially among recreational flyers.

  • Unmanned aerial vehicles are subject to aviation regulations, and if used improperly, they can pose a traffic hazard aviation or public safety.
  • For violation of air traffic regulations unmanned aerial vehicles are subject to criminal penalties, including imprisonment.
  • President of the Civil Aviation Authority recognizing the urgent need to educate users unmanned aerial vehicles in terms of where, how and under what conditions they can be used fly safely, prepared educational material in the form of a leaflet outlining the basic rules of sports and recreational performance of air operations by unmanned aircraft.

Use of flying models, aircraft models and unmanned aircraft with a maximum takeoff mass (MTOM) of 25 kg or less, is generally divided into three segments:

  • Sport and recreational flying in visual line-of-sight (VLOS) operations
  • Sport and recreational flying in out-of-sight operations
  • Flights for commercial purposes

The relevant provisions are contained in Annex 6 to the Ordinance of the Minister of Transport, Construction and Maritime Economy of March 26, 2013. on the exclusion of the application of certain provisions of the Aviation Law to certain types of aircraft and determination of the conditions and requirements for the use of such aircraft. Principles of sport and recreational flying in visual line-of-sight (VLOS) operations:

    • Fly within sight of open space
    • Don't fly near airports
    • Don't fly over people
    • Don't fly over cities and buildings
    • Don't fly over the roads

For safety reasons, drone flights within line of sight are restricted in certain airspace zones.

    • You can't fly, for example, in the controlled zone of an airport, unless you get permission from the Polish Air Navigation Agency to fly into that zone.
    • Regardless of the type of use, in cities over 500,000. residents - there is a ban on flights.
    • Flights are allowed in controlled areas of airports, after obtaining permission from the airport authorities. Flights in other places are possible with the approval of the city authorities.
    • In case of flying in permitted zones, it is advisable to report this fact to FIS - Area Air Information Service.
    • Regardless of the type of flights, it is recommended to purchase liability insurance.
    • Besides, when using any flying vehicle, use a lot of common sense and take care of the safety of yourself, bystanders, other airspace users.

Rules of sport and recreational flying in out-of-sight operations:

    • In fact, in Poland, an unmanned aircraft can only be flown within sight of the operator.
    • For safety reasons, out-of-sight flights are possible only in airspace designated for this purpose.

Commercial flight rules

To fly a drone other than for recreation and sport, you must have:

  • a certificate of qualification, which is a document certifying that the operator can safely control such equipment
  • aero-medical examinations
  • insurance

The certificate of qualification is issued by the President of the Civil Aviation Authority after passing the theoretical and practical exam.
